Oklahoma Governor Files Lawsuit against Biden Administration for Stripping Mining Regulation from the State

Kevin Stitt, the Governor of Oklahoma sued the Biden administration for the decision of the Interior Department to strip the mine regulation from the state, claiming that the act is unlawful and federal overreach, Fox News informed.

The lawsuit set to be submitted on Friday in the District Court of Western Oklahoma District, argues that the Biden administration wants to unlawfully replace the jurisdiction of Oklahoma for regulating surface coal mining and operation reclamation under the Title IV and V of the SMCRA (Surface Mining Control and Reclamation Act) and implement a new federal program to take its place.

The Department of Interior in April, released a notice of the decision, claiming that the state of Oklahoma had no lawful authority under the SMCRA to proceed with the same mining program.
