The Deferred Action for Childhood Arrivals (DACA) program, which was implemented under the Obama administration, was found to be unlawful by a federal appeals court on Wednesday, marking the latest twist in the contentious 2012 regulation’s troubled past, Fox News writes.
The Obama administration was found to lack the jurisdiction to implement the program, which offers protection from deportation to illegal immigrants who entered the nation as minors, according to the 5th Circuit U.S. Court.
Although the policy cannot process new candidates, those who are already enrolled are nonetheless safeguarded from removal because the three-judge bench did not overturn it.
The program is thought to have provided protection to about 700,000 people, and many more are thought to be eligible.
The initiative was controversially established by President Barack Obama through executive order, which was promptly denounced for being an abuse of presidential authority.
Obama claimed that the measure was taken in reaction to Congress’s failure to create a path to citizenship for those who activists and some media outlets referred to as “Dreamers.”
Immigration activists have argued that the policy has put immigrants in limbo for almost ten years, while Republicans have accused Obama of overreaching.
Every two years, the protection needs to be renewed.
Lacking Republican support for amnesty provisions, the left’s hopes for a comprehensive immigration reform bill that included amnesty for millions of illegal immigrants, including DACA participants, have never materialized.
Although it presented a proposal to Democrats that would have extended the program in exchange for wall funding to prevent a government shutdown, President Donald Trump’s administration wanted to eliminate DACA.
But in June 2020, the Supreme Court halted the administration’s attempts to rescind DACA, concluding that they had violated the Administrative Procedure Act (APA), which governs how federal agencies make rules.
President Biden took administrative action in his first days in office to uphold his campaign promise to safeguard DACA.
Additionally, he has called for an all-encompassing immigration agreement with mass amnesty as its cornerstone.
