Two of former President Donald Trump’s children have refused to comply with subpoenas issued by the New York State attorney general’s office.

Donald Trump Jr and Ivanka Trump have refused to testify in a fraud inquiry that is investigating the Trump family business, defying court orders to give evidence. It would be the first time that both Donald Jr. and Ivanka would be questioned under oath.

New York Attorney General Letitia James is conducting a civil investigation into how the Trump real estate business valued its holdings. She opened the inquiry in 2019 looking into claims that Trump before he took the office of president, inflated the value of his assets to banks while seeking loans for his company.

A document filed jointly by the New York Attorney General’s office and an attorney for the Trump Organization named both Donald Trump Jr. and Ivanka Trump as respondents in the ongoing inquiry.

Trump’s lawyers have long tried to stop James from questioning both Trump and his children.

The two Trump kids aimed to squash the subpoenas in a motion filed late Monday night. The attorney representing them both, Alan Futerfas, questioned the motives of the New York Attorney General, saying that her office is involved as well in the ongoing criminal investigation into the Trump Organization.

This inquiry runs parallel to an ongoing criminal investigation by the Manhattan District Attorney’s Office. So far, this parallel investigation has resulted in indictments again the organization itself, and its longtime CFO, Allen Weisselberg, on tax charges.

Prosecutors on the investigation say that the Trump organization has been paying for Weisselberg’s rent, living expenses, car lease, even private school tuition, without proper tax reporting.

Trump sued James specifically in December 2021, saying that she was filing the lawsuits due to political motivation against him.

James has requested that Trump testifies in person in her office before the end of this week.
